Employer timed sacking to prevent unfair dismissal claim: CEO

After allegedly rushing a CEO's sacking to deny him the opportunity to claim unfair dismissal, an employer has been ordered to reinstate him until his adverse action claim can be determined.

Federal Court Judge John Nicholas also restrained the Australian Federation of Islamic Councils (AFIC) from terminating the CEO's employment without the Court's permission, and ordered that his general protections claim be expedited.

The Court heard that on 28 July, the employer received a complaint from a new executive assistant, alleging the CEO told her several times during their first meeting, "the camera really doesn't do you justice", and that he held "unnecessary and prolonged eye contact which made her feel extremely awkward and uneasy". ..
