Scope of redeployment obligations "may change next year"
An important High Court challenge regarding the scope of employers' redeployment obligations during restructures will be a key case to watch in the coming year, lawyers say.
The case involves mining employer Helensburgh Coal Pty Ltd, and roles that it made redundant during the COVID pandemic.
Affected employees challenged whether their redundancies were "genuine", given that the company's restructuring resulted in a 90% reduction in direct employees, and only a 40% reduction in external contracting staff...
