HR's role in a performance review and management process was "worthy of scrutiny", the Fair Work Commission has noted, in ordering an employer to reinstate a senior employee.
"Despite the issues of [the director's] alleged leadership deficiencies being known, there is little evidence of intervention by HR to address those issues in a meaningful way," Deputy President Masson said.
The Commission heard the University of Melbourne sacked the director after an 18-month investigation and disciplinary process found she'd engaged in serious misconduct.
But in unfair dismissal proceedings, Deputy President Masson rejected that the director's behaviour was "rude and disrespectful, micromanaging and controlling, dishonest, divisive, insubordinate, and bullying", as the employer contended...
