Even if it's impossible for an employer to change a decision about planned redundancies, it must comply with its consultation obligations, a workplace lawyer says. Meanwhile, an enterprise bargaining specialist says it's never been more crucial for employers to have skilled negotiators at the table.
The need for employers to consult about redundancies was highlighted last week, when the Fair Work Commission ordered an employer to pay unfair dismissal compensation to an employee, who was one of 23 staff laid off during an "urgent" restructuring process (read HR Daily's full report on the decision here).
