Demoting employee after client complaint wasn't a dismissal

An employee has failed to prove she was unfairly dismissed when her employer transferred to a lower-paid role, following a client's complaint about her performance.

In determining the jurisdictional issue of whether a dismissal had occurred, Fair Work Commission Deputy President Richard Clancy found the employee had "unequivocally confirmed in writing" her acceptance of the employer's proposal.

The site manager started working for Millennium Cleaning in March 2023. She filed an unfair dismissal application in January this year, alleging she was sacked the month prior.

The employer objected to the application on the grounds that it hadn't dismissed her...
