Employee sacked after traumatic hold-up denied permission to appeal

A full bench of the Fair Work Commission has refused to disturb a finding that it was fair to sack an employee who couldn't return to her role after a traumatic workplace incident.

The Commissioner's consideration of harshness hadn't miscarried, the bench said; rather, the employee's appeal grounds showed she disagreed with his overall evaluative assessment.

The Endeavour Group casual employee worked at a Dan Murphy's store in Ballina, and was threatened with a knife during an armed robbery on 18 June 2025

She submitted incapacity certificates until August, but after she remained absent the employer ultimately terminated her employment in November...
