Employer's "persistent disorganisation" forced worker to quit

An employer's "ongoing failure" to pay an employee's wages and superannuation on time left her with no option but to resign, the Fair Work Commission has found.

Harbour City Hospitality objected to the singer and burlesque performer's general protections application involving dismissal on the basis she had voluntarily resigned, but Deputy President Tony Saunders found she was constructively dismissed.

The Commission heard that in November last year, the employee and a colleague were trying to prepare for an upcoming show but found it "impossible to rehearse" because the freelance performers were refusing to work, alleging their invoices hadn't been paid...
