The Fair Work Commission has criticised an employer for requesting a stay of an unfair dismissal compensation order, after it failed to comply with the payment deadline.
This was a "serious matter", Deputy President Alan Colman said, adding that without "some compelling explanation", it wasn't appropriate for an employer to benefit from a stay, in circumstances where it had breached the order its application related to.
Sharn Enterprise Pty Ltd, which owned Little Ted's Childcare Centre in Brisbane, applied for the stay under section 606 of the Fair Work Act, alongside its appeal against a finding that an employee's dismissal was "baseless".
In that ruling, Commissioner Paula Spencer awarded the employee maximum compensation ($17,123 plus super), after finding she was unfairly sacked while undergoing cancer treatment...
