Fair to sack manager whose team were "walking on eggshells"

A manager whose team members were often crying was fairly sacked for creating a psychosocially unsafe workplace, the Fair Work Commission has found.

Following two resignations and interactions that left other team members in tears, Deputy President Tony Saunders found the employer "had to act so that it could comply with its statutory obligation to ensure the health and safety of employees at work".

"[The manager] had an abrupt manner, was rude to members of her team, yelled at them, with the result that they were often crying, anxious and felt as though they were walking on eggshells."

The lifestyle and engagement manager was employed at aged care facility Harbourside Port Stephens for 10 months starting in January 2025. Her termination letter's reasons included that she had: created an unsafe psychosocial environment and negatively impacted the health and safety of the team members who reported to her; and failed to follow lawful and reasonable directions from her superior, the executive manager of residential care...
