Disputes so far about the application of fixed-term contract limits haven't yet resolved all the grey areas in the legislation, a workplace lawyer says.
It's been almost two years since the reforms came into effect, and court and commission rulings handed down since then "do provide a level of clarity regarding dismissal-related claims", says HR Law practice group leader Kristin Duff.
However, she says in a new HR Daily Premium Q&A, "there are still a number of circumstances where a decision not to renew a fixed-term contract can amount to a dismissal, and can give rise to unfair dismissal or general protections claims".
