FWC bench confirms deed "extinguished" general protections claim

A deed of release prevented an employee from pursuing a general protections claim in the Fair Work Commission, a full bench has ruled, in refusing to disturb a finding that he signed it willingly.

Consistent with the Federal Court's "well-established" position, the settlement the senior lecturer came to with Swinburne University of Technology, "operates as a complete answer" to his general protections application, "being a valid and effective accord", the bench ruled.

The employee left the University in September 2024, but in October lodged a general protections claim...
