Shift notifications and emergencies are specifically catered for in the Fair Work Commission's draft 'right to disconnect' clause, but detailed guidance won't be provided until after the new right is in place.
The FWC has used one specific modern award to inform its draft term, published today, noting other awards can be amended after 26 August if need be.
Subclause XX.1 of the draft term says it provides for the exercise of an employee's right to disconnect, which will be set out in section 333M of the Fair Work Act, and subclause XX.2 says it will be effective from 26 August this year for non-small-business employers and 26 August 2025 for small businesses...
