An HR manager's incorrect advice regarding the entitlements an employee would receive if he quit wasn't intended to force his hand, the Fair Work Commission has found.
"The [employee's] decision to resign was entirely free... He might argue he was misled – and relied on that advice – but this is different than being given no choice," Commissioner Benjamin Redford said.
The ANZ head of media at Bean Media Group resigned in January this year, giving two months' notice, the Commission heard.
He subsequently lodged a general protections dismissal claim against the employer and its HR manager, but the employer objected on the basis he wasn't dismissed...
