"Standard casual employment contract" no match for conversion pathway

The Fair Work Commission has expressed a provisional view that a casual should be converted to permanent part-time employment, finding the employer was essentially unable not to offer him work.

"The real substance, practical reality, and true nature of [the employee's] employment relationship... was not that of a casual employee engaged irregularly to perform work on an as needs basis," Commissioner Stephen Crawford said.

Rather, the employee had been an "important, regular, and ongoing" part of his team since "at least 2023"...
