"Patient" employer gave ample warnings about worker's clock-on failures

An employer's patience "understandably ran out" after a worker repeatedly failed to clock on and off despite multiple warnings, the Fair Work Commission has found in upholding her dismissal.

The Mermaid Cleaning Services worker received training on how to use the employer's HumanForce app as part of her onboarding in May 2020, but over the course of her employment until October 2021 she used it inconsistently (only recording roughly one-third of her shifts).

The employee claimed her subsequent dismissal was unfair because the app often didn't "work properly", and in her defence she submitted a message of support from a co-worker, who had also had "a couple of problems" with the app.

But the employer's HR manager said using the app was a simple process, and as well as the induction training the employee also received a handbook containing instructions. She conceded some employees had "teething issues" with the app when they were new, but this was a small number...
