Fair Work Act amendments target dismissal disputes

The Fair Work Commission will be able to resolve disputes about whether an employee has been dismissed without conducting a hearing, under proposed changes to the Fair Work Act.

The Workplace Relations Legislation Amendment (Building Cooperative Workplaces No. 1) Bill 2026, introduced to Parliament this morning by Workplace Relations Minister Amanda Rishworth, aims to enable the Commission to more effectively perform its functions.

According to the explanatory memorandum, the Bill will empower the Commission to deal with general protections dismissal and unlawful termination disputes through, for example, conciliation or mediation, without first having to make an arbitrated decision about whether an applicant was in fact dismissed or terminated.

This would make resolving such matters more efficient and cost-effective for the Commission, and relevant parties...
