Redundancy one day before parental leave wasn't genuine

The Fair Work Commission has cleared an employee to pursue her unfair dismissal claim, rejecting it was a genuine redundancy decision that simply coincided with her planned parental leave.

The sales and retention operator for Intelligent Monitoring Solutions Pty Ltd was informed on 24 September 2024 – one day before she was due to start an approved 12-month period of parental leave – that her role was becoming redundant.

This happened roughly one month after she found out she wouldn't receive four weeks of paid maternity leave (as she had with her previous two children)...
