Accommodating an employee's request to work a "somewhat restrictive" roster would likely lead to perceptions of unfairness and cause workplace tension, the Fair Work Commission has accepted in a flexible work dispute.
Granting the arrangements would also potentially increase the employer's costs and operational inconvenience, Commissioner Paul Schneider found.
The Jellybeans Childcare employee applied to the FWC to resolve a dispute, after the employer introduced a rotating roster that meant she'd no longer always finish work by 330pm, as had been the case since she started in 2023.
