The Fair Work Commission has declined to make orders to stop sexual harassment, after the respondent to the application expressed remorse for his action. Meanwhile a conflict specialist is calling for employers to go beyond policies and documentation, and call out poor behaviour more often.
The employee's application alleged a sexist remark had been made in September 2023. This prompted the respondent to state that he had been wrong to make the remark, and although it was not directed at the applicant, it was unprofessional and inappropriate.
"He said that he regretted making the applicant uncomfortable," said Deputy President Alan Colman, following a conference between the parties. Further, he added, the applicant "did not question his remorse"...
