What constitutes reasonable action in a performance management scenario is illustrated well in a recent Fair Work Commission decision, a workplace lawyer says.
"There's definitely this tension point, with situations where an employer is trying to performance manage an employee, or raise issues about work performance, and the response that's received is allegations of workplace bullying," Henry William Lawyers partner Renee Kasbarian says.
