A Fair Work Commission member has criticised an employee's use of the anti-bullying regime as an attempt to punish and embarrass her managers.
"That is not what the anti-bullying provisions are intended to be used for," Commissioner Stephen Crawford said, in dismissing her claim for want of jurisdiction.
The case involved a Sydney Trains administration officer, who sought stop-bullying orders against three superiors. At the time of proceedings, she was certified unfit to work in her role at Glenfield Network Base, and was performing alternative duties at another site.
Commissioner Crawford noted that during proceedings, the employee said she couldn't return to her substantive position as she did "not feel safe at all"...
