Letting fixed-term contract 'meander to conclusion' constituted a dismissal

A decision that found an employee was dismissed when her fixed-term contract was allowed to "meander to its conclusion" highlights the need for employers to "exercise caution" in this area, a lawyer stresses.

This week, the Fair Work Commission rejected an employer's claim that new fixed-term contract limitations didn't apply to the employee's situation because she signed the contract before the legislation took effect in December 2023.

But HR Law practice group leader Kristin Duff says this finding was "somewhat at odds" with another decision the same day (reported here in HR Daily), which found an HRBP wasn't dismissed when her third fixed-term contract expired...
