An employee has won $432k in damages after an appeal court ruled his employer was liable for a co-worker's drunken behaviour.
The Daydream Island Resort food and beverage manager sought damages from his employer, CCIG Investments, after the incident aggravated his narcolepsy and caused him to suffer post-traumatic stress disorder.
The Queensland Supreme Court heard his position required him to live in shared accommodation and that in November 2016, he woke in the early hours of the morning to his intoxicated co-worker standing next to his bed, urinating on his face. He choked and inhaled the urine, subsequently suffering a cataplectic attack.
The employee claimed the employer breached its duty of care to him, but in May last year Justice Graeme Crow said it would be inappropriate to hold the employer responsible for the co-worker's "mistake", which didn't occur in the course of his employment...
