"Bizarre" bullying claims rejected in psych injury dispute

An employee's "bizarre" bullying and harassment allegations were not based on "real events", a tribunal has found, in denying her compensation for a psychological injury.

Having regard to the "florid nature" of the employee's allegations, NSW Personal Injury Commission Senior Member Rachel Homan said she wasn't satisfied on the balance of probabilities that she was objectively bullied or harassed.

The aged care nursing assistant had been employed by Opal Healthcare since 2019. She claimed that during 2023 and 2024 she was bullied and harassed by "80 to 90%" of her coworkers.

Specifically, the employee claimed that coworkers: talked about her behind her back; called her a "witch"; turned the families of residents against her; threatened her children; and spoke about burning her house down or bombing it.

Incidents like this were occurring "every day", she said...
