"Confrontational and obstinate" employee wasn't constructively dismissed

Despite accusing his employer of unlawful conduct and abusive management practices, an employee had options other than quitting his role, according to the Fair Work Commission.

The employer's actions after the employee's resignation were crucial to this outcome, according to South Geldard Lawyers director Jonathan Mamaril.

The patent examiner, who had been employed by IP Australia since 2012, gave the employer one month's notice of his resignation in February this year.

His letter said: "I cannot in good faith support unlawful, unreasonable, unfair, inefficient, and abusive management practices"...
