Delayed and ambiguous investigation letter forced employee to resign

An employee had no choice but to resign after she complained about s-xual harassment and then wasn't properly informed of the investigation's outcome, the Fair Work Commission has ruled.

Failing to give the employee an investigation summary outcome in writing, and only doing so after she followed up her request, was "unacceptable" conduct, said Deputy President Abbey Beaumont.

On any objective level, it "would give rise to the plausible perception that the employee was not valued by the employer she works for", she added.

The Dnata Airport Services employee resigned on 30 April this year. She then lodged an unfair dismissal claim, to which the employer objected, on the grounds she had not been dismissed...
