"Demeaning" investigation was consistent with standard HR procedures: FWC

It's not uncommon for employees to find investigations stressful and upsetting, but this doesn't mean they're unreasonable, a Fair Work Commissioner has commented in dismissing a stop-bullying application.

Commissioner Paul Schneider accepted the Aegis Aged Care employee felt she had experienced a "demeaning" disciplinary process, but he found the employer's actions were "routine" and not targeted at her specifically.

The employee had sought stop-bullying orders against the employer's Balmoral centre facility manager. But the employer raised a jurisdictional objection, maintaining no bullying had occurred and the manager's actions were reasonable.

It told the Commission that after allegations involving the employee came to light, it followed a "standard and consistent process", as it was required to investigate all allegations of resident neglect or injuries that resulted from neglect.

The employee, however, argued the management action wasn't consistent with how other staff had been treated...
