Demotion in open-plan office would have distressed any employee: court

An employer's misguided approach to addressing an "emotional" supervisor's performance issues could have caused even someone of "normal fortitude" to suffer a psychiatric injury, a court has ruled in ordering it to pay $300k in damages.

Queensland District Court Judge Jennifer Rosengren said the probability of psychiatric injury "was of such a degree that a reasonable person would have undoubtedly done more than what was done by the [employer] to have avoided the risk".

The Pro Music sales supervisor, who had worked for the employer for about 14 years, claimed his psychiatric injury arose due to "the nature and circumstances" of a meeting with the employer's managing director in February 2019, and he sought $500k in damages...
