Dismissal unfair for manager whose performance was "just not cutting it"

Poor attendance at work and refusing to correct behaviour wasn't "sufficiently serious" to warrant a manager's dismissal, the Fair Work Commission has ruled in awarding him 16 weeks' compensation.

The Five Islands Hotel gaming manager claimed he was unfairly sacked in January this year, but the employer objected, arguing he voluntarily resigned.

The Commission heard that a couple of weeks earlier, the manager had asked the employer for a pay increase both for himself and his fellow managers.

In a subsequent meeting, the employer told the manager his performance was "just not cutting it", as he wasn't completing his duties efficiently, and it suggested he resign...
