Dismissal upheld for 'box-ticking' underperformer

An employer has defended dismissing an employee whose performance figures were improving, with the Fair Work Commission finding the quality of his work was his downfall.

CJD Equipment sacked the regional sales manager in March this year, after it found he had failed to perform "in the spirit" of the targets it had set for him over the previous months and had submitted inaccurate data.

In unfair dismissal proceedings, the Commission heard a general manager placed the employee on a performance improvement plan in early 2023, after identifying his year-on-year quotes had dropped from 136 to 87, while colleagues' quotes had remained consistent, and he had the highest number of "uncontacted" customers.

The PIP was put on hold, however, after the employee formally complained the GM had bullied him...
