Dismissal upheld for employee who blamed poor communication on neurodivergence

An employee who complained he shouldn't have to undergo communication training, because he had ADHD and autism, was fairly sacked for misconduct, the Fair Work Commission has ruled.

Deputy President Terri Butler noted the employee had failed to produce any evidence to show that having these conditions excused or explained his conduct.

The Mater Misericordiae sleep technician claimed he was unfairly dismissed in June last year.

His employer claimed it had valid dismissal reasons, based on his unprofessional and disrespectful behaviour.
