Diversity flag in email signature not a sign of FWC bias

A diversity symbol in the Fair Work Commission President's email signature did not suggest he would be biased against a claimant who was "pro-free speech", a full bench has ruled.

According to employment lawyer Paul O'Halloran, the case raises some important considerations around employers' DEI commitments.

The employee in the case was sacked by Monash University earlier this year. He alleges his dismissal breached multiple general protections provisions of the Fair Work Act, and he is claiming more than $100 million in damages and pecuniary penalties...
