'Emotional intelligence' a key factor in HRBP's redundancy selection

An HR business partner, who was chosen for redundancy because she was "a little bit emotional when dealing with conflict" and not confident in her English-speaking skills, has lost her unfair dismissal claim.

The Hisense Australia HRBP claimed she was "targeted" for redundancy after becoming a new mother and taking parental leave, but the employer raised a jurisdictional objection, arguing her role was genuinely redundant due to a change in its operational requirements.

The Fair Work Commission heard the HRBP returned from parental leave in December last year, when she said she experienced a "notable shift in attitude" from the employer's operations director.

About a month after her return, she said, the operations director proposed transitioning her from full-time to casual employment, offering her one-to-two days of work per week, and threatened redundancy if she declined...
