Employee dismissed when employer 'unintentionally' ended contract

An employer repudiated an employee's training contract when it unintentionally terminated instead of amending it, a Fair Work Commission full bench has found in clearing him to pursue his unfair dismissal claim.

In May 2022, the IDrilling Australia casual driller's offsider entered into a training contract with the employer to obtain a certificate in drilling (level 3).

These contracts were facilitated by the Western Australian Department of Training and Workforce Development, and the employee's contract specifically set out that his traineeship was full-time, for 18 months, with 54 hours of work and training per week...
