Employee "got the balance right" between personal and professional devotion

A sacked employee has won reinstatement despite his employer's objections, with the Fair Work Commission accepting he could continue advocating for his jailed partner without adversely affecting its reputation.

Since 2010, when his partner was convicted of murder in a highly-publicised trial, the employee had been aware of the need to balance his support of her with the potential reputational impact that support might have on his employer, said Deputy President Tony Slevin.

The fact the employer wasn't mentioned in media reports until it took disciplinary action against him indicated "[the employee], to his credit, got the balance right", the Deputy President said.

The Commission heard the employee's partner was Keli Lane, who is serving an 18-year prison sentence for murdering her infant daughter...
