An employer that continued to accuse a sacked worker of engaging in criminal conduct has been denied leave to appeal against paying her $14k for unfair dismissal.
Disability support provider Evolving Support Services summarily dismissed the employee for "criminal trespass" in March this year, arguing she unlawfully entered the home of its client after she no longer worked there and took "numerous items" that didn't belong to her.
In subsequent unfair dismissal proceedings, Commissioner Chris Simpson found the employee hadn't engaged in criminal trespass – she had only removed her own property from the home – so there was no valid reason for her dismissal...
