Employee in need of mental health break wasn't sacked

Encouraging an employee to take some time to "sort out" her mental health issues did not constitute a constructive dismissal, the Fair Work Commission has found.

Deputy President Terri Butler said the employer merely intended for the casual worker to take some unpaid personal leave before it considered assigning her more shifts.

This could not be deemed a dismissal at the employer's initiative, she said...
