Employee loses unfair dismissal claim after "playing games" with employer

An employee was "playing games" with his employer when he ignored its messages and refused to comply with directions, the Fair Work Commission has found, in ruling he was fairly sacked for misconduct.

"A meaningful employment relationship cannot exist when an employee demonstrates an ongoing failure and refusal to co-operate with their employer," Deputy President Tony Saunders said.

Australian Postal Corporation summarily dismissed the postal transport officer in September last year.

This followed four months of what it considered serious and wilful misconduct, which allegedly included: taking a company vehicle to KFC for an hour without permission; repeatedly leaving work early; and failing to comply with reasonable directions...
