Employee "need not have been a prophet to see" she was going to be sacked: FWC

An employee who "sought not to prolong the unpalatable dance of termination" and sent a frustrated text to her employer has been cleared to pursue her general protections claim.

The Adelaide Blinds full-time sales consultant claimed she had been unlawfully dismissed, however the employer objected to her application on the grounds that she had resigned.

The Fair Work Commission heard that on 6 February this year, the employer's owner argued with the employee for 45 minutes about her work performance, regarding quotes, sales, conversion rates, and customer service.

Meanwhile the employee complained about commissions and her employment contract, which she received late and which differed from the terms she believed she had agreed upon when accepting the job...
