Employee's attention to detail "evaporated" FWC's tolerance

A Fair Work Commissioner's tolerance for a sacked employee "evaporated" when she failed to meet relevant case deadlines, and he said her lack of attention to detail supported her employer's many dismissal reasons.

Commissioner Bernie Riordan said it was "apparent" the Men's Legal Service solicitor struggled to follow "time-based directions", adding it was "beyond [his] comprehension why an applicant who is a practicing lawyer would not comply with the directions in her own case".

Noting he was "usually very lenient on a self-represented applicant", the Commissioner said after granting the employee an extension of time to provide her witness statement and submissions, his "tolerance evaporated when her reply submissions did not meet the Directions timeframe"...
