The "destabilising" effect an employee had on the workplace was the reason for her termination, and not the bullying complaint she filed just before it, the Federal Circuit Court has ruled in rejecting her adverse action claim.
Despite some "troubling" aspects in the employer's evidence, Judge Stewart Brown found it had "compelling and logical reasons" to end the employment relationship.
The Court heard the Public Service Association of South Australia industrial officer was employed under a 12-month contract that began in June 2022, which was later extended for a further six months, due to expire in December 2023.
In November, however, the employer terminated the contract with immediate effect and paid out the remainder of its duration, also informing the employee it would not extend nor replace her contract with a new one...
