Despite damaging her employer's reputation with clients, an employee would have had "reasonable prospects" of improving her performance if she'd been given the chance to do so, the Fair Work Commission has found in upholding her unfair dismissal claim.
Deputy President Alan Colman found the employer failed to give the employee a "fair opportunity" to address its concerns, and awarded her nearly $10k in compensation.
The employee had worked as a real estate associate with Flynn Corporate for about 18 months before she was sacked in January this year.
In claiming unfair dismissal, the employee acknowledged being told in a December 2025 performance review that she needed to "demonstrate more consistent performance". But in that meeting, the employer's director also told her she had potential and mentioned the possibility of progressing to a full sales role...
