An employer acted "in good faith" when it emailed staff about an employee's health after she suffered a medical episode at work, but it nonetheless breached her privacy, a commission has found.
In April 2021, the employee of a trade wholesale distribution company had a medical episode in the work carpark, which was witnessed by about seven colleagues, who administered CPR until paramedics and police arrived.
When asked by the employer for an update, the employee's husband responded that she was being checked by doctors and was "out of the woods for now".
Later that day, the employer's managing director sent an email titled '[employee's name] – recovering well', to about 110 head office staff...
