Employer didn't 'weaponise' disciplinary process

An employee who insisted performance management and disciplinary processes were "weapons used against him" by hostile managers has lost his psychological injury claim.

The NSW Personal Injury Commission found Willoughby City Council's disciplinary action wholly or predominantly caused the compliance ranger's psychological injury, however it found it was reasonable, despite a "blemish" related to a show-cause meeting.

In seeking workers' compensation, the employee had claimed a series of work incidents contributed to him suffering from stress, anxiety and depression. These included: "unfair treatment and being singled out" for voicing his opinions; being bullied, harassed, targeted and belittled; and receiving a show-cause letter in April last year...
