Employer entitled to accept resignation made "impulsively and in frustration"

It was reasonable for an employer to accept the resignation of an employee who felt "upset and wronged" after a workplace altercation, the Fair Work Commission has ruled.

The employee, who was of Nepalese ethnicity, worked for The Arnhem Land Progress Aboriginal Corporation as a workshop manager in the Northern Territory township of Lajamanu.

In December last year, he and a person from the community had an altercation regarding payment for cigarettes, and a manager intervened and asked the employee to leave the workplace.

A few days later, the employee was checking workshop orders and deliveries on the work computer when he discovered an incident report for the altercation, which he believed wrongly blamed him for what happened...
