Notifying an employee of his impending dismissal meeting using a "banal" phrase didn't put him on notice his job was at risk, but the Fair Work Commission has ruled his redundancy was nonetheless genuine.
Commissioner Mark Perica found the employer's overall process did "not meet the level expected of a large employer with access to senior human resource practitioners".
In August last year, the Laminex Group design team leader was dismissed by reason of redundancy. He subsequently claimed unfair dismissal, arguing he could have been redeployed into a role that was advertised on the "very day he was terminated".
The employer objected to his application on the basis the redundancy was genuine, and noted he didn't have the "trade background" required by the job he was referring to...
