Employer's failure to clarify role confusion was a constructive dismissal

Accepting an employee's resignation without clarifying a misunderstanding about her role amounted to a constructive dismissal, the Fair Work Commission has found.

The employer was aware the employee was quitting because she believed her only other option was to move interstate, and if it disagreed that this was the case, it did nothing to correct her view, Commissioner Julia Fox found.

In dismissal-related general protections proceedings, the employee said she started working for electrical engineering company, EPEC Group, as a casual senior accountant in November 2024.
