Employer's offers to keep consulting about redeployment "rang hollow"

Blaming a general manager for stalling a redundancy consultation process, when the purpose of any further discussion remained "opaque", was "self-serving and disingenuous", the Fair Work Commission has ruled.

In fact, the employer's own conduct could be seen as "the flip side" of what it alleged against the GM; namely, that it asserted a willingness to consult about redeployment to pressure her to reduce her payout expectations, "or simply to leave", Commissioner Damian Sloan said.

Earlier this year, due to concerns about its leadership structure, building company North Homes informed the GM of operations that it was considering moving away from its 'co GM' model.

Despite the GM's suggestions on how to make the model more effective and efficient, the employer proceeded with its decision in April. It told her it would either redeploy her into a sales and marketing role, maintaining her current remuneration, or negotiate a redundancy package...
