Employer shuts down future claims from vexatious employee

An employer has won a vexatious proceedings order against a former employee, after the Federal Court accepted he posed a substantial risk of ongoing litigation if left "unchecked".

The employee's overall conduct demonstrated an "appetite for aggressively and frequently engaging in conflict through litigation", regardless of whether or not that litigation had any reasonable basis, Justice Darryl Rangiah said.

World Vision Australia dismissed the employee in October 2023, during his probationary period, and since then he has commenced various proceedings concerning his employment and termination, including allegations of adverse action, unlawful termination and underpayments for overtime work.

In his most recent claim, the employee alleged he was defamed by the employer and three of its HR staff, after they decided to end his probation period early and told him his "behaviour fell short of the minimum standards of conduct" the employer required...
