Evidence fell "well short" of demonstrating employee's need for flexible work

The Fair Work Commission has shut down a flexible work dispute, finding the employee's evidence of a disability was "not credible", and there was no nexus between his circumstances and his stated need to work from home.

The employer, Make It Mine Finance, had rejected the request for a full-time working-from-home arrangement, which the employee maintained was necessary because he was a parent with caring responsibilities, and because he had a disability (PTSD) that caused him to experience flashbacks when he travelled by car or public transport.

He sought an order from the Commission requiring the employer to grant his request, but in an interim "expression of opinion" issued last month, Deputy President Alan Colman said it appeared that the employee "simply does not want to work in the office". He advised the employee to reconsider whether to press his application, and has since handed down his final decision in the dispute...
